HISID lawsuits' hearings set for this Wednesday
BERRYVILLE -- Two related lawsuits involving the Holiday Island Suburban Improvement District are set to be heard Wednesday in the county courthouse in Berryville by Judge G. Kent Crow.
The David Bischoff v. HISID lawsuit, a request for summary judgment, will be heard at 9 a.m., and the Table Rock Landing v. HISID and Holiday Island Development Corporation suit will be heard at 1:30 p.m. In the second suit, the judge has allowed for three hours on the court docket.
These suits involve the Assessment of Benefits done in 2011 by the HI district, which resulted in an increase in the assessment rate for 2012 and established different rates depending on type of property being assessed. The suits challenge both the legality of the AOB process and the assessment amounts.
The hearings follow two failed mediation attempts in late 2012.
