BERRYVILLE -- Long-time Alderman Joel Gibson was appointed "acting mayor" to preside over Berryville City Council meetings while the town's elected mayor, Tim McKinney, serves six weeks in jail on DWI and marijuana possession charges.

McKinney, who has been mayor since 1991, was ordered to serve 39 days in the county jail here for revocation of 2008 drug and alcohol related suspended sentences -- and was ordered to serve another 15 days in the Washington County Jail on similar charges there.

He is also to undergo an extensive 9-to-12-month drug and alcohol treatment program through Washington County's Drug Court. If he is successful, his felony conviction for second offense marijuana possession, currently held in abeyance, will be expunged, allowing him to serve in public office, vote, and own a gun.

Just prior to reporting to the county jail on Friday, McKinney met with his council for a brief meeting and appointed Gibson to serve in his place during his absence.

He also authorized six week's worth of his mayor's pay, $2,307, be donated to the Berryville Community Center Foundation.

Gibson was chosen to serve in his absence because he has the most seniority on the council. He was appointed by McKinney 17 years ago, and is also the oldest member of the governing body, proud to say he'll be 89 years-old this September.

McKinney checked himself into jail late Friday afternoon to begin serving 39 days of jail time for 2008 DWI and marijuana possession charges.

Those arose after he was stopped for speeding in his pickup by a county deputy. He pleaded guilty to those charges and received a sentence that included suspended jail time -- provided he did not reoffend within a year.

He did reoffend, this time in Washington County, just shy of his year deadline. He was stopped on Interstate 540 in his pickup and was cited for DWI and possession of marijuana, less than a gram.

He faced those charges Friday morning, pleaded guilty, and received the drug court program for the marijuana possession, and 15 days in jail on the DWI 2 offense, besides fees and fines.

He was ordered to start his 15 days in the Washington County Jail on Aug. 10.

I doubt Mr. Gibson going to be the kind of person to toke and drink. Good choice for once, Berryville. As for the Mayor, I wish I was the Mayor. Then maybe superdad Chad Hipps will leave my raped and assaulted family alone.
