New York couple hit by stray bullets from July Fourth reveler

GREEN FOREST ---- A married couple visiting the area from New York sustained gun shot wounds after they were struck by bullets late July 4 on a county road south of Green Forest.

Daniel Daley, a 42-year-old Berryville man, was charged with two counts of aggravated assault in connection with the shooting.

Authorities say Daley had been celebrating the Fourth of July with friends at a CR 992 home south of Green Forest when he took a .22 rifle from his vehicle and fired it, believing he was shooting it in the air.

Instead, a 38-year-old woman and her 41-year-old husband were both struck in the leg by errant bullets.

Ralph Gordon, an investigator with the Carroll County Sheriff's Office, said authorities were dispatched to the scene after someone reported there had been a disagreement.

He said the investigation, which included witness statements, indicated there was no malicious intent on Daley's part, and no alcohol or substance abuse involved.

Gordon said it appears that Daley had fired his rifle in the middle of County Road 992, shortly after 11 p.m. July 4.

The couple from New York, he said, had been watching fireworks with friends and were walking along the county road when the incident occurred.

Gordon said both were transported to St. John's Hospital ---- Berryville, where they were treated then transferred to St. John's in Springfield, Mo., for follow-up and further treatment.

Gordon said there is every indication that this was an accidental shooting. He said Daley was fully cooperative with police and is scheduled for arraignment on Tuesday.

County deputies worked the accident scene with assistance from Green Forest police.
